Terms of Service

These Terms govern your use of the Voice AI Telegram bot, website and related tools. Please read them carefully — particularly Section 5 on voice cloning. By using Voice AI you accept these Terms.

1. Acceptance

By using the Voice AI Telegram bot, website at voice.smolevich.com or any related browser extension or API (together, the “Service”), you agree to these Terms of Service. If you do not agree, do not use the Service.

These Terms form a binding agreement between you and Stanislav Shupilkin, registered as a Serbian sole proprietor (preduzetnik) with its principal place of business in Belgrade, Serbia.

2. The Service

Voice AI provides speech-to-text (STT), text-to-speech (TTS), audio and video transcription and voice cloning features. The Service runs on top of third-party AI providers and depends on their continued availability.

Features, limits and pricing may change. We will give reasonable notice in the bot, on the website or by email before any material change that affects paying users.

3. Account and Eligibility

You must be at least 16 years old to use the Service. By using the Service you confirm that you meet this age requirement.

You are responsible for activity that happens under your Telegram account or any account linked to the Service. Keep your credentials secure and notify us immediately of any unauthorized access.

4. Acceptable Use

You agree not to use the Service for anything illegal, harmful, deceptive or that infringes the rights of others. In particular, you must not:

  • Upload or transmit content you do not have the right to use, including audio of other people without their consent.
  • Use the Service to harass, defame, threaten, intimidate or impersonate any person or organization.
  • Generate content that exploits or endangers minors, promotes self-harm, terrorism or violent extremism, or violates applicable export-control or sanctions law.
  • Attempt to reverse-engineer the Service, bypass usage limits, scrape outputs at scale, resell access without a written agreement, or interfere with the infrastructure.
  • Use the Service to build a competing speech AI service or to train a competing model.

5. Voice Cloning Policy

Voice cloning is a sensitive feature that can be misused. By submitting voice samples for cloning, you represent and warrant that:

  • Either the voice is your own, or you have obtained the explicit, informed, written consent of the person whose voice is being cloned. We may ask you to provide proof of consent before enabling or using a cloned voice.
  • You will not clone the voice of a public figure (politician, celebrity, journalist, executive or similar) without their explicit consent.
  • You will not use any cloned voice for fraud, scams, deepfakes, defamation, sexual content involving the voice owner, political propaganda or any deceptive impersonation.
  • You will clearly disclose to your audience that synthetic speech was used whenever required by applicable law, including under California Civil Code §3344.1, AB-2602, AB-1836 and the EU AI Act.

We may, at our sole discretion and without prior notice, delete voice samples and cloned voice profiles that we believe violate these rules, suspend the relevant account and report the matter to law-enforcement authorities. We may also implement automated and manual abuse-detection measures, including audio fingerprinting of cloned voices.

6. User Content and Outputs

You retain ownership of the audio, text and other content you submit to the Service (“Input”) and of the audio, text or other content the Service generates from your Input (“Output”).

You grant us a limited, worldwide, royalty-free licence to process Input and Output strictly to operate, secure and support the Service. We do not use your Input or Output to train AI models, and we do not sell it to third parties.

Output is produced by statistical models and may be inaccurate, offensive or unsuitable for your use case. You are responsible for reviewing Output before relying on it, and for ensuring that your use of Output complies with applicable law and third-party rights.

7. Subscriptions, Billing and Refunds

The Service offers free and paid tiers. Paid tiers are billed in advance on a monthly or annual basis through our Merchant of Record (currently being onboarded). Fees, billing cycle and included usage limits are stated at the time of purchase.

Subscriptions renew automatically until cancelled. You can cancel at any time from your account dashboard or by contacting us; cancellation takes effect at the end of the current billing period.

Because we deliver digital services that you can consume immediately, fees are generally non-refundable. We will, however, consider refund requests on a case-by-case basis when the Service materially failed to perform as described, where required by mandatory consumer-protection law, or within 14 days of an unused first purchase for EU consumers.

8. Suspension and Termination

We may suspend or terminate your access to the Service, with or without notice, if you violate these Terms, if your account creates risk for us or other users, or if we are required to do so by law. For paid plans, we will refund any unused, pre-paid fees unless the termination is due to a serious or repeated breach.

You may stop using the Service at any time. Sections of these Terms that by their nature should survive termination will continue to apply, including the Voice Cloning Policy representations, intellectual property, disclaimers, limitation of liability and governing law.

9. Intellectual Property

The Service, including the website, bot, browser extension, branding and underlying software, is and remains our property or that of our licensors. Nothing in these Terms transfers any intellectual property rights to you, other than the limited right to use the Service as described.

10. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement and accuracy of Output. We do not warrant that the Service will be uninterrupted, error-free or secure.

11. Limitation of Liability

To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the fees you paid for the Service in the 12 months immediately before the event giving rise to the claim, or (b) USD 100.

In no event will we be liable for indirect, incidental, consequential, special or punitive damages, or for loss of profits, revenue, data or goodwill, even if we have been advised of the possibility of such damages.

Nothing in these Terms limits or excludes any liability that cannot be limited or excluded by law, including liability for gross negligence, wilful misconduct, fraud or death and personal injury caused by negligence.

12. Indemnification

You agree to indemnify and hold us harmless from any third-party claim, demand, loss or expense (including reasonable legal fees) arising out of your Input, your Output, your breach of these Terms or your misuse of the Service.

13. Governing Law and Disputes

These Terms are governed by the laws of the Republic of Serbia, excluding its conflict-of-laws rules. Any dispute will be submitted to the exclusive jurisdiction of the competent courts in Belgrade, Serbia, except where mandatory consumer-protection law of your country of residence grants you the right to bring proceedings in your local courts.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “last updated” date below and, for material changes, we will provide reasonable notice in the bot or by email. Continued use of the Service after the changes take effect means you accept the updated Terms.
